Insurance Europe warned that it would be premature for the Commission to already reopen the text of the GDPR for amendments, given that only two years have passed since the Regulation became applicable. Like many other sectors, insurers have invested significant resources in order to understand the Regulation and to ensure its proper implementation. Opening the GDPR for review at such an early stage would therefore undermine the industry's efforts and investments to comply with the Regulation.
Instead, the Commission's report should take stock of the experiences gained since the application of the Regulation in May 2018. If areas where the GDPR has failed to meet its objectives are identified, the Commission should then consider the development of further or different guidance, together with the European Data Protection Board (EDPB), where relevant.
The Commission's report should also consider the impact of the GDPR on innovation in the insurance industry and address any obstacles that may have unintentionally been created to the development and use of technologies such as artificial intelligence, big data and the internet of things. While these technologies offer significant opportunities for insurers and consumers, their development could be unintentionally undermined by GDPR provisions and/or EDPB guidelines.
