UKRAINE: supervisor and market players discussed measures to preserve the insurance business during martial law

The National Bank of Ukraine (NBU) held an urgent meeting with representatives of the insurance market on the issue of complying with obligations to customers and maintaining the insurance business during martial law, MTIBU (Motor Transport Insurance Bureau of Ukraine) said in its press-release.

Among the proposals made by market representatives, a part concerned MTPL insurance during hostilities:
  • possibility of self-recording of the accident circumstances by the parties under MTPL and Motor Hull insurance;
  • the right of insurers to pay amounts exceeding the current limit of payments under the European Accident Statement.
The NBU recommends that insurers simplify the procedure for settling insured events - as to maximize use of electronic documents, copies of documents if it is impossible to obtain originals, and other means of remote settlement.

General Director of MTIBU Vladimir SHEVCHENKO commented: "MTPL insurers work smoothly. We are doing everything possible so that the citizens of Ukraine have insurance coverage, despite the war that has come to our house". He also said that insurers who are full MTIBU members have made a number of decisions to simplify receipt of insurance protection for citizens traveling abroad by car.

From March 2, for the period of martial law, special tariffs are established for international insurance contracts - Green Card (for cars) with a validity period of 15 and 30 days in the amount of 50% of the current rates (in UAH). Insurers-full members of the MTIBU are prohibited from applying a commission in the amount of more than 5% under international insurance contracts concluded at special rates. In the absence of paper policies, contracts can be issued in black and white copies or by generating pdf files.

On February 28, also states the MTIBU press release, it was announced that Ukrainian travelling abroad by own car will be allowed to cross the border even if they don't have Green Card insurance policies at that time. 

According to a MTIBU press release, this was decided during the meetings of NBU, the Ministry of Foreign Affairs of Ukraine, MTIBU and the relevant authorities of Poland, Slovakia, Hungary, Romania and Moldova. Citizens of Ukraine can cross the borders of these countries without Green Card policies. However, the Bureau notes that car owners need to remember that driving a car on the European roads requires insurance coverage: either a Ukrainian Green Card or a domestic MTPL policy of any member country of the international Green Card system.

So far, except for Moldova, authorities of the five neighboring countries have not explicitly confirm this piece of information. As most Ukrainian entering Moldova by car are, in fact, in transit, the National Commission for Financial Market of Moldova informed that foreign citizens entering the Republic of Moldova in vehicles registered in Ukraine and not having an insurance certificate may enter the country, but must appropriate insurance within 24 hours. 

As for the other countries, it seems that crossing the border by car without a Green Card policy is more a simplification of the procedure on the Ukrainian side. Polish and Slovak insurers have complemented it by offering 30-days border insurance coverage for free, but the obligation of having a form of MTPL insurance was not removed.
